Mustafa Amir murder case: SHC told trial court is vacant

KARACHI: Justice Iqbal Kalhoro while hearing the petition seeking speedy trial of Mustafa Amir murder case on Tuesday, remarked that the high court had directed for early proceedings of the case.

Investigation Officer of the case, Muhammad Ali, informed Sindh High Court (SHC) bench that the anti-terrorism court, hearing the case has been vacant after completion of the tenure of the learned judge.

“Jail Superintendent in a report informed that the accused Armaghan has refused to receive the court notice,” the bench observed. “Concerned court has not been functional, to whom we issue the instruction”.

“We receive pleas for an early completion of the case, it is incomprehensible, why they don’t want to proceed the case,” Justice Kalhoro remarked.

Murder victim Mustafa Amir’s mother had petitioned to court over delay in case proceedings.

Petitioner’s lawyer said the court had in previous hearing directed the defence lawyer to appear in the case. “Accused himself not receiving the notice, the lawyer would appear when the accused will ask him to appear”, bench observed.

The court directed for issuing the notice again to the defendant.

Earlier, trial court in its report to the SHC over delay held prime accused Armaghan and his lawyer responsible for the delay in case proceedings.

The high court bench comprising Justice Iqbal Kalhoro and Justice Abdul Rehman had ordered the trial court for early completion of the proceedings of Mustafa Amir murder case.
