PESHAWAR: The Peshawar High Court (PHC) has removed all petitions challenging the imposition of governor’s rule and emergency in Khyber Pakhtunkhwa from its cause list following an order of the Federal Constitutional Court (FCC).
The petitions seeking the recovery of Chief Minister Sohail Afridi, Speaker Babar Saleem Swati and MNA Junaid Akbar have also been removed from the cause list, according to the latest court proceedings.
The PHC has issued its cause list for November 10, while an official notification directed that writ petitions filed under Article 199 of the Constitution on or after October 12, 2026, should not be fixed for hearing.
The PHC also directed petitioners to approach the relevant forum for relief.
Several petitions challenging the imposition of emergency and governor’s rule in the province had been filed by PTI Chairman Barrister Gohar Ali Khan, opposition leader Mahmood Khan Achakzai, the Khyber Pakhtunkhwa Bar Council and MNA Shandana Gulzar, among others.
The development follows an order issued on Thursday by the Federal Constitutional Court, which restrained the Peshawar High Court from hearing cases concerning the preventive detention of PTI workers and activists under Section 3 of the Maintenance of Public Order (MPO) Ordinance.
The FCC’s directive was issued by a two-member bench headed by Chief Justice Aminuddin Khan and comprising Justice Aamer Farooq.
